Effective change in the hosting regulation

Decisions of the Hosts are final in all cases and have to be implemented/enforced by the DM team. A reasoning for them has not to be provided
All DMs are required to abide by the hosting terms and Host decisions at all times. It is the duty of the DMs to enforce themselves in this regard
Players are innocent until proven guilty. Any punishment - regardless in any form - passed by the DMs has to be proven by the DM(s) in question

Greetings!





I do have a good and a not-so good information for the DM team.








The good:


The good one is that Bert and I are happy with the presence the DMs show, and the individual commitment of the DM team.





The recent additions to the DM team are all very worthy DMs, and they bring some new fresh wind and drive to the server.











The bad:


This however does not mean that everything is fine and dandy. In regard to us hosts, it is not the case for example.





We, your hosts, have decided to terminate our hosting agreement.





At the same time we will issue new hosting terms which are valid from now on, effective immediately.





The following two rules will be added to this new hosting agreement effective immediately:


- Decisions of the Hosts are final in all cases and have to be implemented/enforced by the DM team. A reasoning for them has not to be provided


- All DMs are required to abide by the hosting terms and Host decisions at all times. It is the duty of the DMs to enforce themselves in this regard


- Players are innocent until proven guilty. Any punishment - regardless in any form - passed by the DMs has to be proven by the DM(s) in question





This indeed means and is meant to allow us to override the DM team decisions whenever we deem it necessary for our personal reasons.





It also is a mean to stop the influx of PMs griefing about DMs acting too brashly and punishing groups too quickly for soloing even though they just lost a member.








However, it is still not the desire of the hosts to "take over" Anphillia and tell you everything you have to do. Indeed, the contrary is the case, and we hope to have a better cooperation in the future, which requires way less action from our side in the future. Details will be given further below.








Note that this would not even have been necessary if you would have abided by the old term H-2:

Failure to do so simply means we do slightly clarify this term (the part in italics).








Reasoning for the changes:


Even though we do not need to give a reasoning, we do want to share with you why we take this drastic change. We did not take this change lightly.





1) The primary reason for this change is that the hosts are unwilling to cope with the comments of the DM team following decisions. The hosts do not make any decision lightly, and the history has shown us that even a valid reasoning will be questioned, alongside with our ability to make such decisions. This change clarifies all this.





2) The hosts do not have any desire to have problems enforcing their rulings to be implemented. This change allows us to from now on act immediately and as we deem fit, if a ruling is not abided by anyone for any reason.





3) It is not appropriate that any DM repeatedly challenges the ability of the hosts to take decisions based upon a violation of the hosting agreement. However, this choice will always be that of the hosts. The currently resulting hot tempers however are inappropriate and counter-productive, so this change clearly defines that the hosts can when they deem it necessary.





4) It is not appropriate that any DM repeatedly posts in an inappropriate manner when challenging the hosts. Forging a clear hierarchy will hopefully stop such behaviour.





5) It is not appropriate that any DM repeatedly griefs against them in secret towards the player base. Forging a clear hierarchy will hopefully clarify where the DM power ultimately derives from.





6) It is not appropriate that any DM repeatedly states an opinion as that of the DM team that differs clearly with that of the hosts.





7) Certain punitive actions by the DM team are inacceptable.





We had to declare any attempt to clear the situation a failure after six months of repeated explanations of our side.








What now do you have to expect?


Put plainly, your hosts do hope that in the end you will see and hear less of our influence. If need be, there will not be any more discussion however so we have not to meddle with server afairs longer then absolutely needed.





We still leave the charge in your hands, after slightly modifying the setup of the DM team to better cope with the new hierarchy (see below).





It is not our intention to "take over" this server and mingle in the running of it wherever we can. But since we see more and more need to act because of breaches of and tensions with what was the Hosting Agreement, we hope that changing the hierarchy clearly will in the end clarify that we are serious with our decisions and the hosting agreement.





Also, it might mean that the DM team in certain vital cases will ask the stance of the hosts before making a decision which might result in problems. This is encourages of course, required it is not. But it might help alleviate later problems.





In effect, it is our will to still honour the original hosting agreement, an thus we plan to leave the whole administration to the DM team. We simply had to make this point crystal clear.








Bert, Tino, Sherian and Cookie Monster?


A decision of the hosts will be clearly stated as such from either Bert, Tino or Sherian.





The decision is only valid from any of those three persons, and will usually be done as Bert or via our Liason DM (see below).





Any decision by Sherian can be appealed with Tino, who is the legal responsible person hosting this community. It is however highly unlikely that any such decision will be revoked. It still is your choice to appeal though.





Any decision of Cookie Monster is not a host decision. Do never mix that up please.








Immediate changes affecting the DM team:


The hosts will name a Liason DM, who will be the only DM that the hosts communicate decisions through. It will be the responsibility of the Liason DM to see to proper decision making within acceptable time frames and gets a full backing by the hosts. The Liason DM can chose freely to not accept the position or resign at any time of course.





The Liason DM is like the press relations officer of the Hosts, so treat this position accordingly. It is safe to asume that at times the Liason DM will have to enforce unfavourable decisions because it is the responsibility of the Liason DM to do so.





To be able to do her/his duty, the Liason DM will have the following powers inside the DM team:


1) The Liason DM has the full support of the host and speaks in our name. Any disagreement will be settled between us and the Liason in private


2) When in doubt, the Liason speaks for the Hosts. Any question sent about it to the Hosts by anyone other then the Liason will get a "we support the Liason" answer. If we won't, we will settle this with the Liason in private


3) The Liason DM can set a deadline for votes. This deadline is binding. It should be sufficient for the task at hand


4) The Liason DMs vote wins a tie on any poll


5) The Liason DM can veto any decision of the DM team. A veto has to be justified to the hosts alone, optimally in advance to vetoing a decision. It may be shared with the remaining DMs if desired. Note that this does not mean that the Liason DM can force a new ruling


6) The Liason DM is able to enforce host rulings in any way he/she sees fit. She/he has full host support in this regard


7) Any grief about the Liason DM will have to be brought to host attention via a PM. Griefing, flaming or otherwise attacking the Liason DM for any duty related reason openly is not acceptable. Criticising and discussing with the Liason is completely acceptable.


Any grief brought to the attention of the Hosts regarding the Liason DM will be confidential.








Let me clarify that last point please: the Liason does a job (s)he is required to. The hosts have a zero tolerance position against anyone "mobbing" the Liason. And zero tolerance means it.





The Hosts know too well what it means to defend or enforce a position which is not one's own. Therefore the Liason will get a full backing.





That also means that if tempers get hot, it is the responsibility of the other party to appease and calm the situation, not that of the Liason. Due to the added stress of the position the hosts will give the Liason some wide berth. This noone else can expect however.








The hosts expect that this single person will be an advantage to the community, and will help to smoothing all needed decision processes and the speed of them.








Our Liason DM will be *********.





She is informed of all the details and accepted the position under one condition, which the hosts accepted. We expect full cooperation with Twilight by every DM.








It is the decision of the DM team if they want to share this with the community, and when they do it in what way they explain it.








Advantages for the DM team:


This change also offers advantages for the DM team.





Since the hosts still desire to fully support the DM team in running the community, it will allow the DM team to let the hosts decide instead of themselves. This might not appear like much, but it will move the DMs out of the firing line when possible hated decisions have to be done.





Your hosts are willing to take the full blame for unfavoured decisions. This might give the DM team the freedom to try out new approaches, since even unloved decisions can now be made. Just propose them to the hosts, and we will make your decision and take the blame.





It also has the advantage that once you have our support in one instance, you can be certain that we are backing you in any way possible, in all cases.





Finally, it will give the DM team the incentive to excel at what they are doing in the spirit of what the hosts (and you) want for the community. It will certainly be your aim to not have the hosts step in and overrule you.








Final words:


The content of this post is to be held secret outside DM team for one week at minimum. This includes tells to players or any other forms of communication. This time should be enough for every DM team to rethink the changes calmly and come to terms with this change, and maybe even test it out a bit.





It is a decision of the DM team to make any of the above changes publicly known after one week or not.








We still will support any decision to move the module to another host. All provided features will be made available as they are at the time of the move. The new host will receive an up-to-date version of the database, the vault and the forum if desired.





Further support will not be available after the move however. Neither will the ownership of the domains be transferred.





In any way, the new Hosting Terms will be considered valid however, as long as Anphillia resides on our server or forum.

You are free to comment this change, but please keep in mind that it is not a measure to take over anything. Especially I, Sherian, do not plan to burden myself with being responsible for two communities.





Also, none of the above changes are likely to be reconsidered by us any time soon.

H-9) The DMs can name an undefined number of people to gain a remote access to the server. The login has to be unique for every DM and the DM in question is responsible for it


H-10) The Host will only interfere in running the server if the community as a whole is endangerred or any terms of service are not met. If the host choses to interfere the decision is final - regardless of the cause of the interference


H-11) The service will never be cancelled without an acceptable warning period (at least one month prior) unless a gross violation of any of the terms of hosting are broken


H-12) Sherian speaks for Tino. It has to be assumed that Sherian has the consent of Tino in all cases unless it breaks one of the fundamental agreements mentioned above. [This results in effectively making Tino the host for legal issues, and Sherian the host for online issues, as Tino does not want to be bothered with it and mainly provides the service so that Sherian has not make her identity known anwhere]


H-13) The Host Tino is only to be contacted if really necessary and not bothered by ruling. If at all necessary, Sherian will handle that


H-14) The identity of Sherian as Host is to be kept secret


H-15) Sherian gets a DM access to debug the module. Sherian will not use this to "twink" or "cheat" other people [that was sneaked in here to make my life as Dev easier and necessary as per 3) anyways]


H-16) Failure to comply with these terms may result in immediate shutdown of the service (unlikely) and/or a termination of the hosting agreement within a fixed grace period, or an appropriate measure taken to enforce compliance with the terms
